Italian court approves gradual reunification for off-grid British-Australian family

The Juvenile Court of L'Aquila ruled on 1 September 2026 that an off-grid British-Australian couple may begin a gradual reunification with their three children. British father Nathan Trevallion and Australian mother Catherine Birmingham had their parental responsibilities suspended in November 2025 following state intervention at their woodland property near Palmoli. Under the provisional decree signed by court president Cecilia Angrisano on her final day before transferring to Perugia, the children may immediately visit their parents during post-school afternoons. The arrangement expands in October 2026 to include weekend overnight stays, provided parental support assessments continue under the supervision of social services and court-appointed guardian Maria Luisa Palladino.

The decree, signed by President Angrisano during her final days of service in L'Aquila, partially corrects previous decisions and provides for a gradual reunification of the minors with their families, with immediate daytime returns to Palmoli and, starting in October, weekend family stays.

Legal battle and woodland background

Italian authorities first intervened after all five family members were hospitalized on 23 September 2024 for suspected mushroom poisoning. Social services cited concerns over the lack of running water, electricity, sanitary installations, and peer socialization in the isolated farmhouse the family called Amelia. The court ordered the children placed into care on 13 November 2025, and on 20 November 2025 they were moved to the Genova Rulli facility in Vasto. Birmingham initially stayed at the facility, but judges ordered her removal on 6 March 2026 following reported friction with staff. Justice Minister Carlo Nordio ordered an inspection of the juvenile court two days later, while Senate Speaker Ignazio La Russa met the parents in Rome. During a protected court hearing on 7 July 2026, the children requested to return to their home and their animals, including a horse named Lee, a donkey named Gallipoli, and two dogs.

Schooling requirements and housing preparations

The court decree mandates that all three minors enroll in state education, ending their previous homeschooling arrangement. The nine-year-old girl will enter fourth grade, while the seven-year-old twin boys will enter second grade in separate classrooms. Guardian Maria Luisa Palladino will formalize the registrations, though the court has not determined whether they will attend school in Vasto or Palmoli. Immediate afternoon visits will take place in an apartment granted free of charge to the parents by the Palmoli municipality. For long-term housing, the municipal administration issued a building permit for a new dwelling adjacent to their existing woodland site, where Pescara architect Mascarucci is organizing construction set to begin in September 2026.

Reactions and legal appeals

Palmoli mayor Giuseppe Masciulli praised the decision to begin reintegration but criticized the two-month judicial delay in adopting recommendations from court expert Ceccoli and child neuropsychiatrists.

It is positive that there is an opening and a return program for these children, even if the timing, in my judgment, is extremely slow and dilated.

Defense attorney Simone Pillon, who took over the case on 12 May 2026 following the resignation of previous counsel, announced that the family will appeal the ruling to seek a faster and unrestricted reunification process.
